Agreeing to these terms

These terms apply when you use this website or hire Prime Las Cruces Spray Foam Insulation, called "we," "us" or "our" on this page, for work at your home or business. When you use the site, ask for an estimate or approve a job, you agree to these terms.

If you don't agree with them, please don't use the site or book work with us. If your signed estimate or agreement says something different from this page, the signed document controls for that job.

What we do

We're an insulation contractor in Las Cruces, NM. We install spray foam and blown-in insulation, remove old insulation, air seal attics and walls, and put in crawl space vapor barriers. The services listed on our home page describe what we generally offer. They don't promise that every service suits every house, because the right approach depends on what we find on site.

We're licensed and insured. You can read more about us on our About page.

Information on this website is general. It doesn't replace an in-person look at your attic, walls or crawl space.

Estimates and pricing

We give free in-person estimates, and you're under no obligation to hire us. We base each estimate on what we can see and measure on the visit. That includes the area to cover, how much insulation is already there and what shape it's in, how hard the space is to reach, and the material you choose.

Your written estimate or agreement sets the price and the scope of work. Nothing else on this website is a price quote.

Sometimes we open up a space and find something the estimate didn't account for, such as wet or contaminated insulation, damaged framing or buried vents. When that happens, we'll stop and talk it over with you before doing any extra work. Any change in price needs your approval first.

Scheduling, access and cancellation

We'll agree on a start date with you. Dates can move because of weather, material supply, earlier jobs running long or conditions we find on site. If your date has to change, we'll let you know as soon as we can.

You agree to give our crew safe access to the work areas and to clear stored items from the attic, garage or crawl space entry when we ask. Please tell us ahead of time about pets, known leaks, wiring concerns or past pest problems.

On spray foam jobs, we'll tell you when people and pets need to stay out and when it's safe to come back in, following the foam maker's instructions. You agree to follow that guidance.

If you need to cancel or reschedule, call us at (575) 222-9021 or reach us through our contact page as early as you can. If you cancel after we've ordered materials for your job or started work, you may owe for the materials and labor already provided, as your written agreement states. If we have to cancel, we'll reschedule with you at no cost.

Payment

Your written estimate or agreement sets the payment terms for your job, including any deposit and when the balance is due. Unless it says otherwise, the balance is due when the work is complete.

If a payment is late, we may pause any remaining work until it's settled. We may also charge late fees or collection costs, but only where your agreement and the law allow.

Our guarantee and warranty disclaimers

We back our work with our satisfaction guarantee. If something about the installation isn't right, tell us and we'll come back to look at it.

Any specific warranty for your job is the one written in your agreement. Insulation products may also carry the manufacturer's own warranty. That warranty is between you and the maker and follows the maker's terms.

Apart from your written agreement and any maker's warranty, we provide our work and this website without other warranties, express or implied. That includes implied warranties of merchantability and fitness for a particular purpose, to the extent the law allows.

We don't promise any particular energy savings or drop in your power bill. Results depend on your house, your heating and cooling equipment, the weather and how you use the home.

Limits on our liability

To the extent the law allows, we aren't liable for indirect, incidental or consequential damages that arise from our work or from this website. Examples include lost use of your home and higher utility costs. Our total liability for any claim related to a job is limited to the amount you paid us for that job.

We aren't responsible for conditions that existed before we started, such as hidden water damage, pests, mold or faulty wiring. If we see any of these, we'll tell you.

Nothing in these terms limits liability that the law doesn't allow us to limit.

Resolving a dispute

If you have a problem with our work, call us first. Most issues are settled with a conversation and a return visit.

If we can't work it out together, either of us may bring the matter to a court with jurisdiction in Las Cruces, New Mexico, unless the law requires a different court.

Governing law

The laws of the State of New Mexico govern these terms and the work we do, without regard to conflict-of-law rules. Where the law of the state where a job is done requires otherwise, that law applies to that job.

Changes to these terms

We may update these terms from time to time. The version on this page applies from the date we post it. A job you've already agreed to stays under the terms that applied when you signed.

Questions about these terms
